Sikurse Islami femrën ta konsideronte si qenie të plotë njerëzore do të përcaktonte për të drejta të njëjta dhe të ngjashme , mirëpo ai nuk ka përcaktuar të drejta të njëjta dhe të ngjashme, prandaj ai nuk e konsideron femrën qenie të plotë njerëzore. Të tjerët thonë…….. Çka themi ne…..?

Islami ka filozofi të posaçme e cila ka të bëjë më të drejtat familjare të mashkullit dhe femrës, e cila është në kundërshtim me atë që ka ndodhur në katërmbëdhjetë shekujt e fundit dhe asaj që po ndodh edhe sot. Islami nuk beson në një lloj të drejtave, një lloj të detyrimeve dhe një lloj ndëshkimit edhe për meshkuj edhe për femra në çdo rast. Ai konsideron se një grup ndëshkimesh është i përshtatshëm për meshkuj dhe femra, ndërsa një grup tjetër më shumë i përshtaten femrave. Pasojë e kësaj është që Islami në disa raste ka marrë qëndrim të ngjashëm në aspektin e femrave dhe meshkujve, kurse në rastin tjetër qëndrime të ndryshme. Përse është kështu dhe cili është shkaku për këtë? A mos është kjo për shkak të asaj që Islami, si dhe shumë religjione të tjera, ka qëndrime përçmues ndaj femrës dhe femrën e konsideron lloj inferior apo, ndoshta, ka arsye të tjera dhe filozofi tjetër? Në këtë mënyrë, ata përpiqen të krijojnë përshtypje se këto përcaktime vetëm dëshmojmë se i është shkuar për shtati vetëm mashkullit. Ata deklarojnë se të gjitha rregullat dhe ligjet e botës para shekullit njëzet janë bazuar në përfytyrimin që mashkulli, falë gjinisë së vet, është qenie më fisnike se femra dhe se femra është krijuar për përdorim dhe dobi të mashkullit. në emër të mehrit ( dhuratës së martesës), dhe nuk do të mundësonte pavarësinë e saj ekonomike dhe sociale, dhe nuk do të krijonte prej saj një pensionist të mashkullit i cili duhet ta furnizojë atë. Nga gjërat e thëna më sipër, ata deklarojnë se është konkluduar se si Islami ka pikëpamje poshtëruese ndaj femrës dhe se e konsideron mjet për krijimin e më shumë njerëzve dhe si kusht të domosdoshëm për këtë. Ata shtojnë se përkundër faktit që Islami është religjioni i barazisë dhe ndonëse e preferon barazinë në situate të tjera, në rastin femrës dhe mashkullit ai nuk përmbahet kësaj. Ata deklarojnë se Islami ka mbështetur të drejtat diskriminuese dhe të privilegjuara për meshkujt. Sikurse të kishte për bazë të drejtat diskriminuese dhe privilegjuara për meshkujt, nuk do të urdhëronte ligjet e përmendura me sipër. Nëse e shpërblejmë argumentin e këtyre zotërinjve në modelin logjik Aristotelian , do të ketë këtë formë:

Barazi ose njëjtësi?

Kuptimi bazë i cili përdoret në këto argumente është ai që është e domosdoshme pasoja e pjesëmarrjes së mashkullit dhe femrës në dinjitetin dhe nderit njerëzor qëndron në atë që të drejtat e tyre do të duhej të ishin të njëjta dhe identike. Tani çështja të cilën, thënë në mënyrë filozofike, do të duhej dëshmuar se është përcaktim i saktë cila është ajo pasojë e domosdoshme e pjesëmarrjes së mashkullit dhe femrës në dinjitetin njerëzor. A ka nevojë për konkludimin se cili prej tyre do të duhej të kishte të drejta ekuivalente me ato të tjetrit ati që mos ketë përparësi dhe privilegj në favor të njërit prej tyre apo ndoshta është e domosdoshme që të drejtat e mashkullit dhe femrës, pos asaj që janë identike dhe të barabarta, gjithashtu të jenë saktësisht të njëjta dhe se nuk do të duhej të kishte ndar

je në asnjë punë apo detyrë. Pa dyshim që pjesëmarrja e mashkullit dhe e femrës në dinjitetin njerëzor dhe identiteti i tyre si qenie njerëzore kërkon që ata të kenë të drejta të barabarta njerëzore, porse si mund të ekzistojë identiteti i të drejtave? Nëse e lëmë anash imitimin dhe animin e verbër kah filozofia perëndimore dhe lejojmë vetes të gjykojmë për idetë filozofike dhe qëndrimet që na kanë ardhur prej tyre, fillimisht duhet të par nëse është identiteti i të drejtave ose jo i domosdoshëm për barazinë e të drejtave. Barazia e të drejtave është e ndryshme nga njëjtësia e të drejtave. Barazia e të drejtave paraqet barazi dhe paanësi, ndërsa njëjtësia nënkupton se këto të drejta janë pikërisht të njëjta . Islami nuk është

Ajo që del qartë është se Islami nuk ka lejuar të drejta të njëjta për meshkuj e femra në gjithçka, njësoj siç nuk i ka përcaktuar detyrime dhe ndëshkime të njëjta për të parët dhe për të dytët në të gjitha rastet. A është shuma e të gjitha të drejtave që janë vënë për femrat më i vogël për nga vlera se të drejtat që u janë lejuar meshkujve? Natyrisht që jo, siç do të dëshmojmë.
