Shkurorëzimet e turpshme:
Fillimisht do të diskutojmë për problemin më të theksuar të kohës sonë, gjegjësisht për
shkurorëzimet e turpshme.
Islami është vendosmërisht kundër shkurorëzimit dhe dëshiron anashkalimin e
shkurorëzimit nëse ka sadopak mundësi. Islami do ta aplikojë këtë ilaç juridik vetëm për
rastet kur nuk ka alternativë pos ndarjes. Islami i konsideron armiq të Zotit ata meshkuj
të cilët martohen me gra njëra pas tjetrës dhe shkurorëzohen prej tyre vazhdimisht duke
i quajtur mutal-lek (tekstualisht: ndarës).
Pejgamberi s.a.v.s. deklaroi: “Allahu i konsideron armiq të Tij dhe e akuzon mashkullin i
cili kënaqet me ndërrimin e vazhdueshëm të grave, e cila i gëzohet ndërrimit të
shpeshtë të meshkujve.’’
Pejgamberin e kishin informuar se Ebu Ejub el-Ensariu kishte vendosur të
shkurorëzohej nga Ummi Ejjub – gruaja e vet. Pejgamberi e njihte personalisht Ummi
Ejjubin dhe e dinte se Ebu Ejub el-Ensariu nuk kishte arsye të fortë për ta shkurorëzuar.
Prandaj deklaroi:
– Me të vërtet, të shkurorëzohesh nga Ummi Ejjubi paraqet mëkat të madh.
Pejgamberi gjithashtu ka deklaruar: ‘’Xhebraili më ka folur aq shumë për gratë dhe më
ka këshilluar aq shumë për to, sa kam përshtypjen se nuk vlen të shkurorëzohesh nga
ajo, pos në rast të tradhtisë së dëshmuar.”
Imam Xhafer es-Sidiku r.a. thekson fjalët e Pejgamberit i cili ka thënë: “O për Zotin,
asnjë shtëpi nuk është më e dashur se ajo në të cilën ekziston një unitet martesor dhe
asnjë shtëpi nuk shkakton më shumë zemërimin e Tij se ajo në të cilën uniteti martesor
është e cenuar me shkurorëzim.” Imam es-Sidiku r.a. pastaj deklaron se fjala talak
(shkurorëzim) paraqitet shumë herë në Kur’an dhe se Kur’ani Fisnik i ka kushtuar
vëmendje hollësive lidhur me çështjen e shkurorëzimit. Arsyeja për këtë është se Allahu
është armik i shkurorëzimit.
Tabesi në Mekarimul-ahlak (Fisnikëritë morale) citon Pejgamberin të ketë thënë:
“Martohuni, por mos u shkurorëzoni, sepse froni i Allahut dridhet nga shkurorëzimi.”
Imam es-Sidiku r.a. ka deklaruar: “Asnjë çështje ligjore nuk shkakton aq shumë
zemërim dhe urrejtje tek Allahu sa shkurorëzimi. Allahu, mashkullin i cili shkurorëzohet
shpesh e konsideron armik të Vetin.”
Në Kitab es-Sunen, Ebu Davudi citon fjalët e Pejgamberit të Allahut se Allahu ka thënë
se asnjë çështje e ligjshme nuk është më e ndyrë se shkurorëzimi.
Xhalalud-Din Rumiu, në tregimin e tij të njohur për Musain dhe bariun, duke aluduar për
këto transmetime nga Pejgamberi deklaron: Sa të jetë e mundur mos u shkurorëzoni,
sepse shkurorëzimi është gjëja më e pështirë për mua.
Në biografitë e prijësve tanë mund të vërejmë se ata janë përmbajtur nga shkurorëzimi
deri në mundësinë e fundit. Prandaj janë shkurorëzuar shumë rrallë, vetëm atëherë kur
për këtë kanë pasur arsye të drejta dhe logjike. Për shembull imam el-Bakiri kishte
marrë për grua atë që e kishte dashur. Pastaj e kuptoi se ajo ishte nasibijje, gjegjësisht
e urrente Ali ibni Ebi Talibin r.a. dhe ushqente në zemër lakmi ndaj tij. Imami u nda prej
saj. Pastaj e pyetën: “Ti e dashuroje atë grua, përse u ndave prej saj?” Imami u përgjigj:
“Nuk kam dashur që zjarri i ferrit të jetë në anën time.”
Përse islami nuk e ka shpallur të paligjshëm shkurorëzimin?
Në këtë moment mund të shtohet një pyetje relevante. Nëse shkurorëzimi është aq i
urryer sa që ai që shkurorëzohet nga gruaja konsiderohet armik i Zotit, përse Islami nuk
e ka shpallur shkurorëzimi të paligjshëm? Çka e pengoi Islamin që ta shpallë të
paligjshëm shkurorëzimin dhe ta lejojë atë vetëm në raste të posaçme? Me fjalë të tjera,
a do të ishte më mirë për Islamin që t’i caktonte kushtet dhe t’i lejonte vetëm mashkullit
të shkurorëzohet nga gruaja në këto rrethana? Nëse shkurorëzimi do të ishte i
kushtëzuar, aty domosdo duhet të paraqitet aspekti gjyqësor. Sa herë që mashkulli do
të donte të shkurorëzohej nga gruaja e vet, së pari do të duhej të parashtronte dëshmi
para gjyqit, që kanë të bëjnë plotësimin e kushteve të kërkuara. Nëse gjyqi e konsideron
dëshminë e tij të besueshme dhe argumentet e tij të arsyeshme, ai do të marrë leje të
shkurorëzohet, përndryshe jo.
Çka është pas gjithë kësaj domethënia e vërtetë e deklarimit: shkurorëzimi është më e
pështira nga të gjitha gjërat e lejuara? Nëse shkurorëzimi është gjë e lejuar, atëherë
nuk është e pështirë, e nëse është e pështirë nuk është e ligjshme. Të jesh i pështirë
dhe të jesh i ligjshëm është kontradiktore. Pos kësaj shtrohet pyetja: nëse shoqëria, me
fjalë të tjera ai që quhet pushtet gjyqësor dhe që e prezanton shoqërinë, ka të drejtë në
shkurorëzim, për të cilin thuhet se është i urryer dhe i pështirë, a nuk mund të
inkuadrohet ajo në shkallë aq të lartë sa të mund ta pengojë shkurorëzimin e nxituar
dhe ta zgjatë aq gjersa njeriu të mos ndryshojë vendimin e vet? Në një kohë tjetër
shoqëria, do të thotë po ajo gjyqësi, do të mund të kuptonte se martesa për të cilën
bëhet fjalë është me të vërtetë inkompatibile dhe se do të ishte më mirë që kjo lidhje të
zgjidhet.
