Të drejtat dhe përgjegjësit e gruas në të kaluarën

Sot, të drejtat e femrës janë një ndër temat më bashkohore në trojet shqiptare dhe në përmasa botërore. Të jesh femër në ditët e sotme shpesh konsiderohet si fatbardhësi, kurse në kohët më të hershme ishte vetëm një fatkeqësi. Në Romën antike dhe në Greqinë e lashtë femra nuk kishte asnjë të drejtë. Babai mund t‘i shiste vajzat e tij kurdo që të dëshironte, mund t‘i jepte hua ose t‘i mbyste, sipas dëshirave të tij, si dhe të tjera gjëra të këtij lloji. Kështu pra, femra nuk kishte asnjë të drejtë si qenie njerëzore. Para burrit nuk kishte asnjë të drejtë pronësie, as të bënte ndonjë vizitë ose udhëtime të shkurtër, qoftë edhe për nevojat e tyre personale.

Në Greqinë e lashtë nuk ekzistonte martesa e zakonshme. Grekët jetonin në grupe dhe fëmijët nuk e njihnin nënën e tyre. Poligamia nuk ishte diçka e zakonshme, por çdo njeri, sipas gjendjes ekonomike, mund të mbante në shtëpi një numër të caktuar grash, jashtë martese. Me një fjalë, femra nuk kishte një status juridik dhe burri i martuar me të mund ta falte si dhuratë ose ta jepte hua. Ajo mbahej si pronë, ashtu siç mbaheshin skllevërit dhe kafshët që përdoreshin për nevoja të ndryshme.

Lëvizjet feministe

Lëvizje feministe quhen lëvizjet që përpiqen për të drejtat e femrës. Sipas historianëve perëndimorë, historia moderne e Lëvizjeve Feministe ndahet në tri periudha. Periudha e parë fillon në shekullin XIX-të e XX-të, e cila merrej kryesisht me të drejtën e votimit, punësimit dhe arsimimit. Periudha e dytë fillon në vitin 1960 dhe vazhdon deri në vitin 1980, e cila merrej me të drejtat ligjore, kulturore dhe rolin e femrës në jetën shoqërore. Periudha e tretë fillon nga viti 1980 dhe vazhdoi deri në dhjetëvjetëshin e parë të shekullit XXI dhe gjatë kësaj periudhe vazhduan përpjekjet e periudhës së dytë për të fituar të drejtat që kishin dështuar apo nuk ishin realizuar. Termi “feminizëm” apo “feministe” së pari u paraqitë në Francë dhe Holandë në vitin 1872, në Angli në vitin 1890, kurse në Shtetet e Bashkuara të Amerikës në vitin 1910.

Femra dikur nuk konsiderohej njeri

Në shek .V, “Këshilli nga Makoni” u mblodh në mënyrë që të shqyrtonte “Të vërtetën rreth femrave”. Qëllimi ishte nëse ato kanë apo jo shpirt. Në fund të studimit erdhën në përfundimin se të gjitha femrat kanë shpirt të prishur, janë të dënuara me mallkim të përjetshëm, dhimbje dhe qëndrim në zjarr, përveç Marisë, nënës së Jezusit. Etërit e shenjtë të ritit katolik e kanë konsideruar femrën si përgjegjëse për mëkatet. Sipas tyre, “trupi i femrës është derë për hyrjen e djallit”, ndaj ajo është mallkuar përgjithmonë. Në vitin 586, “Këshilli i të Shkathtëve” shpalli se gruaja nuk i takon gjinisë njerëzore dhe është krijuar vetëm për t’i shërbyer njeriut. Sot nuk janë më sekret apo fshehtësi krimet nga më mizoret që janë bërë ndaj femrës gjatë historisë. Anglia, një ndër shtetet që sot radhitet ndër më kryesorët në mbrojtjen e të drejtave të femrës, dikur i ka masakruar në mënyrën më çnjerëzore. Një ndër to ishte dhe dënimi për virgjërinë. Për të ndëshkuar femrat, përdorej një mjet, i cili shërbente për të eliminuar kontaktin seksual me meshkujt. Ky quhej rrip i virgjërisë. Shitblerja e femrave u lejua në Angli deri në vitin 1805. Çmimi i tyre ishte 5 peni. Një ndër autorët më të njohur që ka bërë studimin historik të trajtimit të femrave, Kahn shkruan në një libër të posaçëm për to: “Në Angli, në shekullin XVI, vetëm të gjalla janë djegur rreth 8 milionë femra. Duhej që të vinte viti 1850, që femra të konsiderohej si qytetare, ndërsa më 1882 kishte të drejtën e posedimit të pronës”.

Në Francë, më 1586, ende diskutohej, nëse femra ka shpirt dhe se a i takon gjinisë njerëzore. Vetëm më 1938 është shpallur ligji për të drejtën e pronës dhe posedimin e llogarisë bankare. Ndërsa E. Figar thotë: “Deri vonë gruaja nuk ka pasur të drejtën e votës, ishte e përjashtuar nga jeta kulturore dhe punët publike”. Deri para një shekulli, kudo në Perëndim, vendi i femrës ishte në shtëpi dhe puna më e madhe e saj ishte kujdesi që bënte për fëmijët. Ato ishin plotësisht të varura nga burrat e tyre apo meshkujve të tjerë. Një lloj i tillë i dhunës kishte vazhduar me shekuj.

Të drejtat e femrës në ditët e sotme

Në ditët e sotme, femrat po fitojnë gjithnjë e më shumë të drejta, gjithashtu, kanë më shumë rol dhe integrim në jetën sociale, politike e ekonomike. Me gjithë këtë, mjerisht, ende vazhduan dhuna fizike, psiqike ndaj saj, keqtrajtimet e ndryshme, deri në mbytje, vrasje. Kështu ndodhë në të gjitha kontinentet, nga Azia në Afrikë, nga Australia në Amerikë. Statistikat tregojnë se sot mbi 4 milionë gra janë viktima të akteve të rënda të dhunës nga të dashurit apo bashkëshortët, çdo vit. FBI-ja (Byroja Federale e Hetimeve) thekson se 30% e grave, që vriten në Shtetet e Bashkuara, janë viktima të dhunës nga të dashurit apo bashkëshortët.

Të drejtat e femrës në Islam

Islami është jo vetëm fe apo religjion, por është edhe një sistem shoqëror, ekonomik, kulturor, politik, juridik, ku përfshihen të gjitha dimensionet e jetës që çojnë drejt së Vërtetës. Femra në Islam është vlerësuar, çmuar që në fillim të shpalljeve të Muhammedit a.s. (paqja qoftë mbi të) duke e bërë atë të ndershme, me vlerë dhe me përgjegjësi në shoqëri. Islami, si një sistem jete i përsosur, ligjet e veta rreth femrës i ka sistematizuar në të gjitha fazat e jetës, në të gjitha format, qysh si fëmijë, jetime apo me prindër, vajzë e re, e martuar, e shkurorëzuar, motër apo nënë, nuse apo plakë, ajo ka vlerën, rëndësinë, autoritetin, kufizimet dhe përgjegjësinë. Dallimi gjinor në mes burrit dhe gruas është dallim njerëzor, por jo hyjnor. Ky dallim, tek krijesat ekziston, por tek Krijuesi kjo dallueshmëri ka kuptimin barazi. Zoti i dallon krijesat vetëm sipas diturisë, besimit, veprimit, devotshmërisë, jo kurrsesi sipas gjinisë.

Islam ka garantuar të drejtat e barabarta të mashkullit dhe të femrës, gjithashtu, i konsideron të barabartë në të gjitha të drejtat dhe përgjegjësitë njerëzore. Ajetet kuranore e vërtetojnë këtë qëndrim: “O njerëz, Ne ju krijuam prej një mashkulli dhe një femre dhe ju ndamë në popuj e fise që të njiheni. Më i devotshëm tek Allahu është ai i cili Atij i frikësohet më së shumti”. (Surja el-Huxhurat, ajeti 13)

“Asnjërit prej jush që mundohet, mundin e tij nuk do t’ia mohojmë, as mashkullit as femrës, ju jeni njëri prej tjetrit”. (Surja Ali Imran, ajeti 195)

Allahu e ka urdhëruar femrën që të vishet: “Thuaju besimtareve që të ulin shikimet e tyre (nga e ndaluara), ta ruajnë nderin e tyre dhe të mos i shfaqin stolitë e tyre (pjesët e trupit), përveç atyre që janë të dukshme”. (Surja en-Nur, ajeti 31)

Ky urdhër, si edhe të tjera, nuk janë mohim, pengim apo cenim i të drejtave të saj, por është udhëzim, që çon në shpëtim, që mos të bie në greminë të degjenerimit, përbuzjes apo përçmimit…
